My Grandmother (the owner of the house) passed away last February. She did not have a will. My Aunt was named her power of attorney right before my Grandmother died. My Aunt contacted an attorney to put the house through probate. Now let me tell you, my family as no money whatsoever, almost everyone is laid off right now. So, she contacted an attorney a friend recommended and this guy said he would take care of probate. He charged her a reasonable price because she was referred by a friend. Well, he started all the probate paperwork and getting the ball rolling. This was maybe about in March. During this time, everything was switched over to my aunt’s name except, obviously, the mortgage. She contacted the mortgage company to try and make arrangements to pay the mortgage. The mortgage company would not make any arrangements with her or give her any information concerning the mortgage because her name was not on the house. She explained the situation to them and they told her to fax the Power of Attorney and a letter stating that she was executor of the estate. Well no one, to this day, has been named executor of the estate, but we did fax over the Power of Attorney letter. This was not good enough for the mortgage company. They still would not give her any information. The mortgage company did not send any statements or anything to the house because my Grandmother had everything set up online. My Aunt could not get in to her online account because she did not know the password. Now my question is, the mortgage company is foreclosing in February. They sent a letter to the house with the sale date. My Aunt contacted another lawyer and he called the mortgage company and they told him the only way to stop the foreclosure was to pay off the whole amount of the house. My family does not have enough money to hire a lawyer to help with the foreclosure. Alright, My question is: if i get approved for an auto loan around $25,000, and i’m wanting to get a vehicle that is only $16,000, and I am upside down by $6,000ish on current auto loan, would the $25,000 be able to cover the difference? The table lists the following information: Loan Amount: 7,000 Monthly Repayment: 178.40 Number of Repayments: 60 Total Amount Repayable: 10,704 Representative Rate: 18.2% APR Now what is confusing me is, where does the 18.2% APR come in to it? If you lend 7,000 and have to pay back 10,704, then the interest is: 10,704/7000 -1 x 100 = 52.9%. Is 18.2% what you pay each year? If so, please show a mathematical representation of how this is worked out. I have never had a loan before but if I do get one I would like to understand how much I am actually being charged for it. Do the banks work out the total percentage rate they want on the loan (in this case 52.9%) then divide it by the number of months you will be paying it back over? The table in the letter also gives an example for if I was paying it back over 84 months instead of 60 months and as expected the total amount repayable goes up. It still doesn’t make it clear where the representative rate comes in to it. Is that just to trick those that aren’t clued up when it comes to mathematics of finance? The whole thing is just confusing to me and i’d really like to get to the bottom of it."

Taxes bankruptcy / reaffirm?
I recently filed bankruptcy chapter 7, my sister and her family resides in the house I soley own in gEORGIA which was included in the bankruptcy and I live in N.Y. I was wondering if I don’t reaffirm with the first and second mortgage companies and my sister continues to stay current with both mortagages would the mortgage company continue to pay the property taxes as they have done in the past. Also would I still be able to claim the house on my taxes like I have done in the past as a rental property claiming the repairs and taxes since its listed on my bankruptcy. These are my concerns, the reason I chose not to reaffirm is because in case she stop paying a year or 3 years from now, I wouldn’t be able to file for bankruptcy for another 10 years. I am trying to improve my credit since filing for bankruptcy. One day I’ll like to own and live in my own home or condo, which would take years due to my bankruptcy. Every three years or so I trade in my vehicle for a newer model. In the past I have always financed my new car with an auto loan from my local bank. I was able to rollover the difference if there was any left over from the old loan to the new loan. But I recently moved much closer to my work, school, and shopping areas. How do I get out from under a mobile home loan?
I have a manufactured home in a park with rental lots. The lot rents have increased to nearly double what they were when I bought the home four years ago. Coupled with the payment on the home I am so upside down I cannot live there. I have been renting it out but now even the renters cant pay the rent. I have been eating some of the increases but cannot do so any more. I contacted the finance company and they said they would refinance for 3k. I told them if the interest was not lowered I could not pay and they would then have to take the mfgd home back. They laughed and said it was my problem. What position can I take to force the finance company to renegotiate the interest on the loan, currently at 12%. Is there any way for force the mobile home park to hold the increases. The place is now a dump and absentee owners will not make any improvements that would make the cost worth the effort."

Alright, My question is: if i get approved for an auto loan around $25,000, and i’m wanting to get a vehicle that is only $16,000, and I am upside down by $6,000ish on current auto loan, would the $25,000 be able to cover the difference? Or will it only cover the value of the vehicle I am wanting to purchase? In this case would only be $16,000 and I lose out on the other $9,000 of the $25,000 loan? Value of my current car (according to KBB) is $10,500ish I owe $16,837 on it and 60 day Payoff is around $17,100 If i get approved for $25,000 auto loan and wanting to purchase a $16,000 car, would the $25,000 be used to cover the difference in what my cars worth to what i owe on top of the new car price (which is around $22,000, the new car price with the negative equals $22,000) Which the end result means I drive away with the new car and my new auto loan is around $22,000?
